Anthony Staines and James Crouch recently obtained a defense verdict on behalf of a long-time client. A former deckhand filed suit alleging benzene exposure caused him to develop Classic Hodgkin’s Lymphoma. At trial in St. Tammany Parish, Tony and James challenged whether the former employee could succeed on general and specific causation. The parties offered competing toxicology opinions, with the defense also offering expert testimony in epidemiology and oncology. The Court found the methodology employed by defendant’s toxicology greatly superior to that of plaintiff’s toxicologist and more convincing and ruled in favor of the defense, finding plaintiff failed to meet his burden of proof on both general and specific causation.
